Welcome to UnbeataBall. These Terms of Service (“Terms”) govern your access to and use of the UnbeataBall mobile application, website, and related services (collectively, the “Service”).
UnbeataBall is operated by Legitico (“UnbeataBall,” “Legitico,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
1. Eligibility
You must be at least 13 years old to create an account or use UnbeataBall.
If you are under 13, you may not use the Service or provide personal information through UnbeataBall.
If you are under the age of majority where you live, you may use UnbeataBall only if you are legally permitted to accept these Terms or have the permission of a parent or legal guardian.
By using the Service, you represent that you meet these eligibility requirements and are not prohibited from using the Service under applicable law.
2. The UnbeataBall Service
UnbeataBall provides tools that allow users to:
- Discover and create recreational sports groups
- Organize games and schedules
- Communicate through group messaging
- Create and join teams
- Manage participation and RSVPs
- Create polls
- Record game statuses and scores
- Share photos, reactions, and other group content
- Record shared real-world field or venue expenses
- Discover sports activities based on location
UnbeataBall provides a technology platform. Unless expressly stated otherwise, UnbeataBall does not organize, supervise, operate, control, or guarantee any group, game, event, venue, payment arrangement, or in-person activity created by users.
Group administrators and other users act independently and are not employees, agents, partners, representatives, or contractors of Legitico.
3. Account Registration and Security
You agree to:
- Provide accurate and reasonably current account information
- Maintain the security of your email account, device, and authentication credentials
- Keep verification codes, access tokens, passwords, and other security information confidential
- Notify us promptly if you suspect unauthorized account access
- Accept responsibility for activity conducted through your account, except where prohibited by law
You may not create an account using another person’s identity or impersonate another person, organization, team, or entity.
You may not sell, transfer, rent, or share your account with another person.
4. Acceptable Use
You may use UnbeataBall only for lawful purposes and in accordance with these Terms.
You may not use the Service to:
- Harass, threaten, intimidate, bully, stalk, or abuse another person
- Post or promote hate speech or discriminatory content
- Post sexually explicit, exploitative, or otherwise prohibited sexual content
- Encourage violence, self-harm, illegal activity, or credible threats
- Impersonate another person or misrepresent your identity or affiliation
- Post fraudulent, deceptive, misleading, or defamatory content
- Send spam, repetitive messages, excessive links, or unauthorized solicitations
- Distribute malware, malicious code, phishing attempts, or harmful links
- Collect another user’s information without authorization
- Share another person’s private or sensitive information without permission
- Post content that infringes copyright, trademark, privacy, publicity, or other rights
- Circumvent moderation, filtering, bans, access controls, or security measures
- Interfere with the operation, reliability, or security of the Service
- Scrape, harvest, reverse engineer, probe, or access the Service through unauthorized automated means
- Use UnbeataBall for unlawful gambling, wagering, fraud, or prohibited financial activity
- Submit knowingly false, abusive, retaliatory, or misleading reports
- Encourage another person to violate these Terms
5. User-Generated Content
“User Content” includes content users create, upload, send, submit, or share through UnbeataBall, including:
- Profiles and profile photos
- Group names and descriptions
- Messages and photos
- Polls and reactions
- Team and participation information
- Game details, statuses, schedules, and scores
- RSVPs and location information
- Expense-ledger information
- Reports, explanations, support requests, and appeals
- Other content submitted through the Service
You retain ownership of your User Content.
By submitting User Content, you grant Legitico a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, display, transmit, distribute, modify for technical formatting, moderate, and otherwise use the content as reasonably necessary to:
- Operate and provide the Service
- Display the content to intended users and group members
- Protect users and maintain platform safety
- Investigate reports and enforce these Terms
- Maintain, troubleshoot, and improve the Service
- Comply with applicable law
This license continues for as long as reasonably necessary to provide the Service. Certain content may remain in backups, moderation records, audit logs, or other users’ records after deletion where permitted by law and described in our Privacy Policy.
You represent that:
- You own your User Content or have permission to submit it
- Your User Content does not violate these Terms
- Your User Content does not infringe another person’s rights
- Your User Content is accurate where accuracy is reasonably expected
You are solely responsible for your User Content and the consequences of sharing it.
6. Content Filtering and Spam Prevention
UnbeataBall uses server-side safeguards intended to detect or restrict certain objectionable text and spam in user-authored chat messages, poll questions, and poll options.
These systems may evaluate content for patterns associated with serious threats, sexual content, hate speech, harassment, excessive links, repeated characters, rapid duplicate messages, and unusually high posting frequency.
Content that triggers these safeguards may be rejected before publication.
Automated filters are not perfect. They may fail to detect prohibited content or may incorrectly restrict permitted content. You may not attempt to evade these safeguards through altered spelling, symbols, spacing, encoding, repeated accounts, automation, or other methods.
7. Reporting, Blocking, and Moderation
From a chat message’s long-press menu, users may:
- Report the message
- Report the member
- Block the member
Groups may also be reported from the Group page.
When submitting a report, users may select a report reason and provide an optional written explanation.
Blocked members’ user-authored messages are hidden from the blocking user. Blocked members can be reviewed and unblocked under Settings. Personal blocking is separate from administrative moderation and platform bans.
Reports and reporter identities are restricted to authorized moderators. The identity of a reporting user is not disclosed to the reported member.
Authorized moderators may:
- Review reported content, members, and groups
- Delete reported messages
- Ban or unban members
- Mark reports as Open, Reviewing, Resolved, or Dismissed
- Take other reasonable action necessary to enforce these Terms or protect users
A platform ban may restrict access to chat, groups, teams, memberships, RSVPs, games, schedules, locations, polls, expense ledgers, and related Service features.
Moderation actions may be recorded in a restricted, append-only audit log.
Submitting a report does not guarantee a specific outcome. To protect user privacy and platform security, we may not disclose all details about an investigation or action taken.
8. Moderation Appeals
Users who believe a moderation decision was made in error may access Moderation Appeals under Settings or contact:
Appeals should include enough information to identify the account and decision. Do not include passwords, one-time verification codes, access tokens, refresh tokens, payment credentials, or other sensitive authentication information.
We may uphold, modify, or reverse a moderation decision after review. An appeal does not automatically suspend an account restriction or platform ban while the appeal is pending.
9. Group Administrators
Group administrators may manage group settings, memberships, teams, games, schedules, locations, polls, scores, and shared expenses.
Group administrators agree to:
- Act honestly and responsibly
- Avoid misleading or abusive use of administrative privileges
- Protect members’ personal information
- Accurately represent group activities and expenses
- Avoid discrimination, harassment, retaliation, or favoritism that violates these Terms
- Use group-management tools only for legitimate group purposes
UnbeataBall does not guarantee the accuracy, fairness, availability, or conduct of a group administrator.
We may restrict or remove administrative privileges when reasonably necessary to protect users or enforce these Terms.
10. Group Expenses and External Payments
Group administrators may use UnbeataBall to record and display shared costs for real-world fields, venues, or related group activities.
Expense ledgers may show:
- The total field or venue cost
- The number of members sharing the expense
- Each member’s allocated amount
- Whether each member has been marked as paid or unpaid
UnbeataBall provides organizational recordkeeping only. We do not:
- Process or hold funds
- Transfer money between users
- Verify that a payment occurred
- Guarantee the accuracy of a ledger
- Guarantee that a member will pay
- Collect debts
- Issue refunds
- Resolve payment disputes
- Store payment-card numbers, bank-account numbers, or payment-service credentials
Payments are arranged directly between users outside UnbeataBall, including through cash or independent services such as PayPal or Venmo.
Before sending money, users are responsible for verifying:
- The recipient’s identity
- The requested amount
- The purpose of the payment
- The external payment method
- The payment status shown in the ledger
Do not share payment credentials, passwords, verification codes, card information, or banking information through UnbeataBall.
UnbeataBall is not a party to external transactions or disputes between users. Users are responsible for resolving payment disagreements directly with one another or through the applicable external payment provider.
11. Location Information
UnbeataBall may use precise or approximate location information, with permission, to display nearby sports groups, games, venues, and distance information.
You are responsible for deciding what location information to share. Do not publicly post your home address or another sensitive private location.
When creating or attending a game, use an established public sports facility or another appropriate meeting location whenever possible.
Location information may be incomplete, delayed, inaccurate, or unavailable. Do not rely on UnbeataBall for emergency navigation, emergency response, or personal safety decisions.
12. Real-World Activities and Assumption of Risk
Participation in sports and in-person activities involves inherent risks, including:
- Physical contact
- Falls and collisions
- Equipment-related injuries
- Weather and environmental conditions
- Property loss or damage
- Transportation risks
- Interactions with unfamiliar people
- Serious injury or death
You are responsible for assessing whether an activity, venue, group, or participant is appropriate for you.
You should:
- Use suitable equipment
- Follow applicable facility and game rules
- Consider your health, experience, and physical ability
- Stop participating when conditions feel unsafe
- Seek professional advice when appropriate
- Contact local emergency services when immediate assistance is needed
UnbeataBall does not conduct comprehensive background checks on users and does not guarantee another user’s identity, behavior, intentions, qualifications, skill level, or safety.
To the fullest extent permitted by law, you voluntarily assume the risks associated with participating in user-organized sports, games, meetups, travel, and related activities.
13. Safety During In-Person Meetings
When meeting users in person, we recommend that you:
- Meet at established public sports facilities or populated locations
- Tell a friend, family member, or guardian where you are going
- Avoid meeting alone when possible
- Arrange safe transportation
- Keep personal and financial information private
- Leave if a situation feels unsafe
- Contact local emergency services when necessary
UnbeataBall’s reporting tools are not emergency services and should not be used as a substitute for contacting law enforcement, medical services, or other emergency responders.
14. Privacy
Our collection and use of information is governed by our Privacy Policy.
Our age and safety practices are also described on our Age Suitability and Safety page.
By using the Service, you acknowledge that information may be collected, processed, shared, and retained as described in those policies.
15. Intellectual Property Rights
Except for User Content and third-party materials, the Service—including its software, design, features, branding, graphics, text, code, and organization—is owned by or licensed to Legitico and is protected by applicable intellectual-property laws.
These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purposes.
You may not copy, modify, distribute, sell, license, reverse engineer, create derivative works from, or exploit the Service except as permitted by law or with our written permission.
16. Copyright and Intellectual-Property Complaints
You may not upload content that infringes another person’s copyright, trademark, privacy, publicity, or other rights.
If you believe content available through UnbeataBall infringes your rights, contact:
Include:
- A description of the protected work or right
- Identification of the allegedly infringing content
- Information reasonably sufficient to locate the content
- Your contact information
- A statement explaining your good-faith belief that the use is unauthorized
- Any other information reasonably required by applicable law
We may remove or restrict allegedly infringing content and may suspend or terminate repeat infringers where appropriate.
17. Third-Party Teams, Leagues, and Trademarks
UnbeataBall is an independent platform and is not affiliated with, endorsed by, sponsored by, or associated with any professional team, league, federation, association, or governing body unless expressly stated.
Team and league names may be used solely to identify users’ stated interests. All third-party names, logos, and trademarks belong to their respective owners.
No ownership, sponsorship, endorsement, affiliation, or partnership is claimed or implied.
Users may not upload or use third-party logos or protected materials unless they have the necessary rights or permission.
18. Third-Party Services and Links
The Service may interact with or reference independent third-party services, including mapping services, email providers, analytics providers, PayPal, Venmo, websites, venues, and other resources.
Third-party services are governed by their own terms and privacy policies. UnbeataBall does not control and is not responsible for:
- Third-party availability or security
- External transactions
- Third-party content or conduct
- Third-party fees, refunds, or disputes
- Third-party data practices
Your use of third-party services is at your own risk and may be subject to additional terms.
19. Suspension, Restriction, and Termination
We may remove content, restrict features, suspend accounts, revoke administrative privileges, or terminate access when we reasonably believe:
- These Terms have been violated
- A user presents a safety, fraud, abuse, or security risk
- An account is being used unlawfully
- Action is necessary to protect users or the Service
- Action is required by law or a valid legal request
- Continued access could expose us or others to liability
Where appropriate, users may appeal moderation decisions through the Moderation Appeals feature or by contacting us.
Users may stop using the Service or request account deletion at any time. Account deletion does not eliminate obligations or disputes arising before deletion, including external payment disputes.
Sections that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute provisions—will remain in effect.
20. Service Changes and Availability
We may modify, suspend, discontinue, or restrict any part of the Service.
We do not guarantee that:
- The Service will always be available
- Features will remain unchanged
- Content will always be preserved
- Errors will always be corrected immediately
- Every group, game, venue, user, score, expense ledger, or message will be accurate
We may release updates that are necessary for security, compatibility, safety, or functionality.
21. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available.”
Legitico disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and security.
We do not guarantee:
- The identity or conduct of any user
- The safety or quality of any activity, group, game, venue, or event
- The accuracy of scores, schedules, locations, payment ledgers, or user content
- That content filtering or moderation will detect every violation
- That the Service will be uninterrupted, error-free, or completely secure
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
22. Limitation of Liability
To the fullest extent permitted by law, Legitico and its owners, affiliates, personnel, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, goodwill, property, or opportunity arising from or related to:
- Use of or inability to use the Service
- User Content
- User conduct
- Sports participation or physical injury
- In-person meetings
- Venue conditions
- Transportation
- External payments or expense disputes
- Unauthorized account access
- Moderation decisions
- Third-party services
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights available under applicable consumer-protection law.
23. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Legitico and its owners, affiliates, personnel, service providers, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from or related to:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of another person’s rights
- Your organization of or participation in a group, game, or event
- Your external payment arrangements
- Your unlawful or harmful conduct
This section does not apply where prohibited by law.
24. Changes to These Terms
We may update these Terms to reflect changes to the Service, our practices, safety requirements, or applicable law.
When changes are made, we will update the effective date. When required, we may provide additional notice through the Service, website, or email.
Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.
If you do not agree to updated Terms, stop using the Service and request account deletion.
25. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the mandatory laws of your jurisdiction apply.
Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
26. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without our written permission. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or similar transaction.
These Terms, together with the Privacy Policy and any additional policies presented through the Service, constitute the entire agreement between you and Legitico concerning the Service.
